1. Services Provided

The Photographer agrees to provide a complimentary photo session for the Client during their vacation at the agreed location and time. The Client understands that while the photo session is complimentary, the purchase of images is not included and is optional, subject to the pricing packages outlined in this Agreement. 

2. Photo Session Details

The session will last approximately [1 hour] and include candid, posed, or other types of photography as discussed prior to the session. The Photographer reserves the right to modify the location or timing in case of unforeseen circumstances, such as weather or safety concerns, with notice to the Client. The Client cannot ask the photographer to leave the general premises of the Property or ask the Photographer to enter the Client's private room. 

24 hours notice must be given from time of booking to time of shoot.

3. Image Review and Purchase Options

After the session, the Photographer will present a collection of edited images for the Client’s review. The Client can then choose to purchase images in prepackaged bundles.

A La Carte: Images of the resort of the surrounding area are also available for individual purchase.

4. Image Delivery

Purchased images will be delivered to the Client in digital format via an online gallery or download link within 3 days of package purchase. Any prints, albums, or other physical products will be delivered after purchase.

5. Payment Terms

• No payment is required for the session itself.

• Payment for image packages must be made upon selection.

• No images will be delivered until full payment is received.

6. Cancellation Policy

The Client may cancel or reschedule the session with no penalty by providing at least [X] days’ notice prior to the session date. In case of cancellation with less than [X] days’ notice, the Photographer reserves the right to charge a cancellation fee of $[Fee Amount].

If the Photographer must cancel due to unforeseen circumstances, the session will be rescheduled at a mutually convenient time or location at no additional cost.

7. Photographer’s Rights

The Photographer retains all copyrights to the images captured during the session. The Client is granted a license to use purchased images for personal use only, which includes social media, prints, and sharing with friends and family.

The Client is prohibited from using the images for commercial purposes unless prior written permission is obtained from the Photographer, and additional licensing fees are agreed upon.

If the Client uses the images for advertising or monetary benefit, the photographer has the right to invoice the Client for a commercial license fee.

8. Model Release

The Client grants the Photographer and Property the right to use images from the session for promotional, advertising, or portfolio purposes unless otherwise stated. If the Client does not agree to this use, they must notify the Photographer in writing before the session date.

9. Liability

The Photographer is not liable for any injury, loss, or damage to persons or property that occurs during the photo session. In the event that digital files are lost, damaged, or destroyed through equipment failure or any other unforeseen circumstance, the Photographer’s liability is limited to a reshoot or a refund of any payments made for the purchased images.

10. Agreement Terms

This Agreement constitutes the entire understanding between the parties and cannot be amended except in writing and signed by both parties. By checking the box, the Client agrees to all terms and conditions outlined above.
